Erosion and Sediment Control Plans

As required by state sediment control law, Environment Article, Title 4, one of the main responsibilities of the Garrett Soil Conservation District is the review and approval of erosion and sediment control plans.

The law requires that prior to initiating any activity that disturbs more than 5,000 square feet or involving more than 100 cubic yards of earth, an erosion and sediment control plan be submitted to and approved by the local soil conservation district.

This review and approval process is integrated with the county stormwater management review and approval process, and for successful applicants, results in the issuance of a County Grading Permit.

About Erosion and Sediment Fees

  • Stormwater Management/Grading Permit Fees should be paid to the Garrett County Permits & Inspections Division when you make your application for the Grading Permit.
  • Erosion and Sediment Control Plan (E&S Plan) review fees need to be paid to Garrett Soil Conservation District.

For E&S Plan reviews, please make checks payable to Garrett Soil Conservation District and mail to: 1916 Maryland Hwy, Ste C, Mt. Lake Park, MD 21550. Our office is also open 8:00 am to 4:00 pm, Monday – Friday. We cannot accept debit or credit cards at this time, but we are in the process of making it possible for you to pay online.

We will not be able to start reviewing your plan until fees are paid.

Please be advised that if we have to ask for revisions there will be an additional $200 charge. Therefore, please read the available documentation on this site to make sure you have addressed everything in your plan before you submit it.

When you apply for the Grading Permit at the Courthouse, they will send us your plan, so you will only need to pay the Erosion and Sediment Control Plan Review fee to begin the process for E&S review. You do NOT need to send us your plan separately.

Permitting fees are as follows:

  • Residential Single Family Permit (up to 30,000) sq ft of disturbed area – $150.00
  • Each additional 30,000 sq ft of disturbed area for Residential Single Family Permit – $75.00
  • Agricultural Forest Harvest Permit – $75.00 plus .50 for each acre of disturbed area
  • Non-Residential & Multi-Family Permit – Commercial – up to 1 acre of disturbance – $300.00. 
  • Each additional acre of disturbance for Non-Residential & Multi-Family – $200.00
  • Concept Review – $200.00
  • Required Resubmissions – $200.00

Each incomplete plan that requires a resubmission is subject to the $200.00 resubmission fee. 

All fees must be paid at the time the application is submitted. Applications will not be reviewed until fees have been paid in full.
